Representative Andy Biggs (R-AZ) called for the passage of his Injunctive Authority Clarification Act on X (formerly Twitter) after a judge blocked President Donald Trump's invocation of the 1798 Alien Enemies Act to deport members of Venezuelan prison gang Tren de Aragua.
On Friday, federal judge James Boasberg ordered the reversal of planes carrying the alleged gang members and future removals to El Salvador after their President, Nayib Bukele, offered to detain members there.
As Politico explained, Boasberg sought to determine the legality of Trump's invocation of the 1798 Alien Enemies Act, only used three times in American history in wartime scenarios, to justify the deportations, as Tre de Aragua is not a foreign government.

Rep. Biggs's Injunctive Authority Clarification Act, introduced in January of this year, prohibits federal courts from issuing injunctive orders that bar enforcement of a federal law or policy against a nonparty unless a party in a class action lawsuit represents the nonparty.
However, as Politico noted, Boasberg's injunction responded to a provisional class-action lawsuit by immigrants' rights advocates, although ABC News has said the Trump Administration has ignored Boasberg's ruling.
Biggs is not the first to decry the numerous federal judges who have sought to undermine President Trump's agenda.
Near the end of February, his colleague Representative Eli Crane (R-AZ) filed articles of impeachment against Judge Paul Engelmayer, who had blocked the Department of Government Efficiency (DOGE) head Elon Musk and associates, including the Secretary of the Treasury Scott Bessent, from accessing sensitive Treasury records.
Rep. Crane called the block "an overtly political emergency request by 19 Democratic attorneys general aiming to prevent Trump administration officials from accessing a payment system within the Treasury Department."
