This includes independent lab testing (functional, accessibility, and red-team penetration), followed by issuance of a new Certificate of Approval that details the exact changes, risks, and mitigations. Automatic or remote updates without prior certification must be strictly prohibited, with violations triggering immediate decertification, fines up to $50,000, and criminal referral under § 1850. To ensure transparency, the new certificate and full examination report must be publicly posted on the Department of State website within 30 days, reported to the Legislature and Auditor General within 45 days, and made viewable on demand to counties, parties, and observers. This builds on the efficient 2018 5.5-to-5.5-A process (60–90 days, <$100K) while closing loopholes for unvetted changes, aligning with Act 77 and VVSG 2.0, and restoring public trust through verifiable, accountable updates. This would prevent or slow last minute updates, that seem to happen hours before the election that are non public and unverified.
