Maricopa County Supervisor Mark Stewart: I am grateful to the Arizona Supreme Court for its thoughtful and expeditious ruling. The Court has provided important legal clarity. At the same time, I hope the Arizona Legislature can build on that guidance by revisiting and clarifying the statutory language governing the respective responsibilities of county boards of supervisors and county recorders. While the Court has resolved the dispute before it, case law alone is not the ideal way to define these relationships for the long term. As future situations arise in other counties, questions and unintended consequences may emerge that are better addressed through clear, modern legislation. Arizona now has an opportunity to establish a durable statutory framework that clearly defines responsibilities, respects the independence of elected offices, encourages collaboration, and keeps the focus where it belongs: the voter. I remain optimistic that with the Court’s guidance and thoughtful legislative action, we can strengthen election administration across Arizona, provide greater certainty for future officeholders, and avoid unnecessary conflicts in the years ahead.
