Arizona Attorney General (AG) Kris Mayes is filing suit against the owners of the Sedona Springs, Sienna Ridge, and Summit Ridge apartment complexes in Tucson for repeatedly failing to fix persistent air conditioning problems in the complexes' units, which could prove deadly in the scorching Arizona summer.
AG Mayes' press release describes how residents' complaints date back to 2023, with temporary fixes such as window units failing to meet the Pima County requirement that homes be cooled to 80 degrees Fahrenheit or less.
Not only do the window units fail to cool more than one room at a time, but the uncooled rooms often reach or exceed 90 degrees.
Moreover, residents have complained of pests, broken windows, structural issues, and water or gas problems, which the owners have failed to inform potential tenants before they sign a lease. Not only do these problems point to persistent neglect, but the failure to disclose could potentially violate the Arizona Consumer Fraud Act and the Arizona Residential Landlord and Tenant Act.
As a result, AG Mayes is seeking a permanent injunction against the owners of the complexes until they make the necessary repairs, barring them from renting out apartments until these demands are met and requiring the payment of restitution to residents harmed by the neglect.
The companies targeted are Sedona Springs AZ, Sienna Ridge AZ, Summit Ridge AZ, DMR Sedona Springs AZ, DMR Tucson 1166, and Tucson 1166 IG, as well as Dasmen Residential and Luxford Living.
"All Arizona residents who enter into rental agreements deserve living conditions that meet minimal standards of habitability," the Attorney General announced in a press release. "The ongoing neglect Dasmen Residential and Luxford Living continue to display by failing to supply adequate air conditioning to residents at Sedona Springs, Sienna Ridge, and Summit Ridge puts residents' lives at serious risk, especially during extreme summer heat."
In July, Mayes sent a letter to Asset Living, LLC and Spectra West Apartments, which owned a complex in Glendale, for similarly failing to meet demands for air conditioning repair.
