Arizona Court Strikes Down Republican Ballot Measure Because It Would Have Banned All Public Sector Unions

A court ruling Tuesday removed HCR 2040 from Arizona's November ballot, with a judge finding that a measure presented as targeting teachers' unions contained language broad enough to eliminate all public sector union activity in the state.

Maricopa County Superior Court Judge Gregory Como ruled that HCR 2040 violates Arizona's Separate Amendment Rule, which requires proposed constitutional amendments to address only a single subject.

The judge explained that, because the measure's language extended well beyond teachers' unions to cover all public-sector unions in Arizona, he concluded it sought to accomplish more than one constitutional change at once, thereby making it invalid.

"The court finds no ambiguity," Como wrote, pointing to the measure's own definition of "labor organization," which he said was sweeping in scope and made no specific mention of teachers' unions or school employee associations.

When the measure shifted to addressing contracts with local governments, The Arizona Mirror reported that Como wrote, "it flatly prohibits the State of Arizona or any local government from contracting with any labor union."

Previous Concerns

Arizona Senate Democrats said they had raised concerns about the measure's scope from the beginning.

"Senate Democrats fought this measure from day one because we knew it was a dangerous precedent for all public employee unions," the caucus said in a statement. "Its misleading language didn't just target teachers. We warned Republicans about the constitutional flaws. The court agreed."

The measure had proposed restricting school districts from using public money or resources to support union operations, deducting union dues from employee paychecks, or allowing union activity during work hours.

Supporters argued it was intended to prevent taxpayer funds from being used to support union organizing. Critics said the measure's language extended far beyond that stated goal, potentially affecting the collective bargaining rights of police officers, firefighters, and other public employees.

Public safety unions had also raised concerns during the legislative process, arguing that, despite being framed as a measure for teachers, its implications extended to their members as well.

With the ruling now in place, HCR 2040 will not appear on November's ballot, a significant development for both sides heading into the fall election season.
